Privacy Policy
The following document outlines our Privacy Policy and its application to a software platform that includes a web interface and a mobile application downloadable from major app stores.
At THE WISE SEEKER S.L. (hereinafter referred to as The Wise Seeker), we place great importance on your privacy and operate in full compliance with the provisions of Regulation (EU) 2016/679 of April 27 (GDPR) and Organic Law 3/2018 of December 5, on Data Protection and Guarantee of Digital Rights (LOPDGDD).
1. Data Controller
The Wise Seeker, with its registered office at Collado Mediano, 6, bis, 28034, Madrid, CIF number B88209929, and email address info@thewiseseeker.com, is the data controller for the personal data of
the user collected or generated as a result of the user’s access, use, or navigation within the platform,
both through any of its web interfaces and its mobile application.
2. Purpose of Data Processing
The Wise Seeker is a platform whose ultimate purpose is to facilitate the connection between professionals seeking employment and companies in need of talent. To achieve this goal, the platform enables a series of assessments and requests additional data from its users, which form an objective profile of their psychological characteristics and knowledge. These assessments may be associated with a specific selection process or not, as there are additional services that derive added value from the analysis and processing of data obtained through these mechanisms.
The Wise Seeker will process user data, manually and/or automatically, for the following specific purposes:
- Provide companies with specific information about the psychological profile and knowledge of candidates participating in their processes within the platform.
- Facilitate contact between users seeking employment and companies seeking talent within the platform.
- Propose areas of improvement to platform users based on their psychological profile and knowledge.
- Suggest job offers to platform users tailored to their psychological profile and knowledge.
- Suggest other services to the user that may be of interest after analyzing their behavior within our platform.
- Ensure the quality and effectiveness of the services offered by our platform.
Furthermore, The Wise Seeker may process user data to verify compliance with their contractual obligations as well as those legally established.
The processing of data is carried out in accordance with Article 6.1.a (you have given your consent for the processing of your personal data until further notice) and/or 6.1.b (the processing of your personal data is necessary to fulfill a contract or to carry out pre-contractual measures) of the General Data Protection Regulation 2016/679.
3. Data Categories
Considering the purposes mentioned in the previous section, The Wise Seeker processes the following categories of data:
- Identifying data of platform users: name, last name, postal address, email address, postal code, phone number, etc.
- Identifying data of companies that initiate a process within the platform: corporate name, address, CIF (tax identification number), billing information, etc.
- Data regarding the psychological profile and knowledge of platform users obtained from assessments.
- Data regarding the education and work experience of platform users that they have provided.
- Data on the use of the platform by its users, as well as certain metadata derived from electronic communications exchanged with users.
- Data related to commercial, economic, financial, and banking information used in the corresponding activities of offering and providing services by The Wise Seeker.
The data requested within the platform is mandatory, and the refusal to provide them will result in the impossibility of providing the contracted services.
The user guarantees that the provided data are true, accurate, complete, and up-to-date, and is responsible for any direct or indirect damage or harm that may occur as a result of non-compliance with this obligation.
If the user provides data from third parties, they affirm that they have the consent of those individuals and commit to conveying to them the information contained in this clause, exempting The Wise Seeker from any responsibility in this regard. However, The Wise Seeker may conduct verifications to confirm this fact, taking the necessary due diligence measures in accordance with the General Data Protection Regulation 2016/679.
4. Data Retention Period
At The Wise Seeker, we store personal data for as long as necessary to fulfill the purposes described above, unless you revoke the consents granted in accordance with Article 5.1-E of the General Data Protection Regulation 2016/679. If necessary, we will retain data for the corresponding legal purposes, deleting them upon the expiration of the legal retention period.
Once this period has elapsed, your personal data will be deleted after all necessary actions have been taken to manage and conclude any remaining obligations between the parties, including all required administrative procedures.
Likewise, if you decide to delete your account at any time, all related data will be deleted by The Wise Seeker, and it will not be recoverable or accessible after deletion.
Notwithstanding the above, your data will be duly blocked while any liabilities may arise, as well as for the fulfillment of other legal obligations incumbent upon The Wise Seeker. In this regard, The Wise Seeker guarantees that it will not process the data unless necessary for the formulation, exercise, or defense of claims or when required to provide them to the Public Administration, Judges, and Courts during the statute of limitations for your legal rights or obligations.
5. Security Measures
At The Wise Seeker, we make every effort to ensure the security of your data in accordance with the General Data Protection Regulation 2016/679 and Organic Law 3/2018 on Data Protection and Guarantee of Digital Rights.
Your personal data, including your orders and client login, will be encrypted for transmission using the SSL (Secure Socket Layer) encryption system, which is considered a security measure by the Spanish Data Protection Agency based on the provisions of Article 32 of the General Data Protection Regulation 2016/679. Online data transmission (e.g., via email) may have security vulnerabilities, and complete protection of data against third-party access is not possible.
To protect your data, we maintain technical and organizational security measures in accordance with the article mentioned in the previous paragraph, which we regularly update to reflect technological changes.
We cannot guarantee that our platform will be available at all times or during specific moments. Server disruptions, interruptions, or downtime cannot be excluded from the normal behavior of a software platform. The servers we use to support the platform are properly backed up to provide the highest service availability to our users.
6. Data Sharing
Within the scope of providing its services, The Wise Seeker will provide user data to companies that create and manage processes within the platform, as this is its purpose. Likewise, the data provided by companies within their processes will also be made available to users participating in these processes in search of employment. This exchange of information is necessary for the platform to fulfill its objective.
In addition to the normal platform activity, in certain cases provided for by current regulations, we may disclose user data to:
- Public Administrations with jurisdiction in the sectors of activity of The Wise Seeker, as required by current regulations.
- State Security Forces and Bodies in accordance with the law.
- Banks and Financial Institutions for the collection of offered services.
In general, The Wise Seeker may provide user information to other professionals, as long as such communication is required by regulations or for the execution of contracted services.
7.Legal Basis
The legal basis for processing our users’ data comes from the consent provided by the data subject in accordance with Article 6.1-A of the General Data Protection Regulation 2016/679. Furthermore, the management of service contracting, payment, billing, and related shipments is legitimized by the execution of the contract established in Article 6.1-B of the General Data Protection Regulation 2016/679.
As for the registration of professional job offers that we may publish on our platform, legitimacy is based on the user’s consent. This consent can be withdrawn at any time in accordance with Article 7.3 of the General Data Protection Regulation 2016/679.
8. Data Subject's Rights
In accordance with Articles 15 to 22 of the General Data Protection Regulation 2016/679, The Wise Seeker informs the user that they have the following rights under the applicable regulations:
- Access: Allows the data subject to obtain information about whether The Wise Seeker is processing personal data concerning them and, in that case, enables their right to obtain information about that personal data being processed.
- Rectification: Allows the data subject to correct errors in the data provided, modifying data that is found to be inaccurate or incomplete.
- Erasure: Allows data to be deleted and cease processing by The Wise Seeker, unless there is a legal obligation to retain them and/or other legitimate reasons for their processing prevail.
- Restriction: Under the legally established conditions, it allows data processing to be halted, in a way that prevents The Wise Seeker from processing them in the future, and will only keep them for the exercise or defense of claims.
- Objection: In certain circumstances and for reasons related to their specific situation, users may object to the processing of their data. The Wise Seeker will stop processing the data, except for compelling legitimate reasons, or the exercise or defense of possible claims.
- Portability: Allows the user to receive the personal data they have provided to The Wise Seeker and transmit them directly to another data controller in a structured, commonly used, and machine-readable format. To exercise this right, a valid email address must be provided.
The Wise Seeker ensures the adoption of the necessary measures to ensure the exercise of these rights free of charge, for which the user should send an email to the address protecciondedatos@thewiseseeker.com, attaching a copy of their national identity document.
As established in Article 12.4 of the General Data Protection Regulation, the exercise of these rights will be processed by The Wise Seeker within a maximum period of one month. However, depending on the complexity of the request, the full implementation of certain rights may take longer, in no case exceeding an additional two months, with prior notification to the data subject.
If you believe that The Wise Seeker has not respected any of the rights mentioned above, you have the right to file a complaint with the Spanish Data Protection Agency, located at C/Jorge Juan nº6, 28001, Madrid.
